Statements of the Minister of Finance under section 24 (3) of the Budget Transparency and Accountability Act.

As required by section 24 (3) of the Budget Transparency and Accountability Act (BTAA), this statement is to provide the reasons for the Minister of Finance to recommend the following:

Designation of the following colleges as “education and health sector organizations” under the BTAA:

  • British Columbia College of Nurses and Midwives
  • British Columbia College of Oral Health Professionals
  • College of Complementary Health Professionals of British Columbia
  • College of Health and Care Professionals of British Columbia
  • College of Pharmacists of British Columbia
  • College of Physicians and Surgeons of British Columbia

Section 24 (2)(d)(ii) of the BTAA provides authority to the LGIC, on recommendation from the Minister of Finance, and following consultation with the Auditor General, to designate an entity as an education and health sector organization. Sections 13 and 16 of the Act do not apply to designated organizations, thus the entity would not be subject to requirements to each year table a Service Plan on Budget Day and an Annual Service Plan Report with Public Accounts.

The colleges are self-funded and are currently administered by a board consisting of a majority of elected college registrants along with government-appointed representatives. Upon the Health Professions and Occupations Act (HPOA) coming into force all board members will be government-appointed through an arms-length process managed by the Health Professions and Occupations Regulatory Oversight Office (HPOROO). Consequently, once the HPOA comes into force, the colleges will be considered part of the “government reporting entity” (GRE) as “government organizations” under the BTAA.

This designation still meets the spirit and intent of BTAA sections 13 and 16 by:

  1. Providing publicly available annual reports to the Ministry of Health; and
  2. Providing financial reporting as required by the Office of the Comptroller General for inclusion in Public Accounts and Estimates.

The designation can be revoked by Cabinet and the LGIC in future years if the Ministry of Finance finds that these reporting requirements have not been met.
